An estimated 40% of the nations mesothelioma cases are filed in Texas,
although most of the plaintiffs have little or no connection to the state.
Texas became the 4th state to pass U.S. legislation to limit and regulate
asbestos lawsuits in Texas courts. That reform bill made changes to the way
asbestos cases are handled and decided. It is seen as a model for other states
to take similar actions.
Generally, the Texas reform is seen as favorable to big businesses and
corporations, but parts do protect the rights of plaintiffs as well. Some of the
key components of the bill include a requirement that plaintiffs establish
medical documentation to prove impairment in order to file an asbestos related
lawsuit, regulations that eliminate and restrict the bundling of cases as well
as an extension ion of the two year statute of limitations to help preserve the
rights of plaintiffs to bring suit when and if they do become impaired.
With nearly half of all the asbestos lawsuits in the U.S. filed in Texas, it's
